6. Intellectual Property Rights

Our Intellectual Property: All content, features, and functionality on this website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Funky Cat Digital Marketing and are protected by copyright, trademark, and other intellectual property laws.

Client Work Product:

  • Upon full payment, clients receive specified usage rights to deliverables as outlined in individual service agreements

  • Funky Cat Digital Marketing retains the right to use work samples for portfolio and marketing purposes unless otherwise agreed in writing

  • Any pre-existing intellectual property or proprietary methods remain the property of Funky Cat Digital Marketing

Client-Provided Content: Clients warrant that any content, images, or materials provided to us do not infringe on third-party rights and grant us necessary licenses to use such materials in providing our services.

7. Warranties and Disclaimers

Limited Warranty: We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. Our sole liability for breach of this warranty is to re-perform the defective services.

8. Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to our services, with or without notice, for any of the following reasons:

  • Fraudulent, abusive, or illegal activity

  • Non-payment of fees

  • Providing false or misleading information

Upon termination, your right to use our services ceases immediately, though payment obligations for services already provided remain in effect.

In no event shall Funky Cat Digital Marketing be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
